Freehold vs leasehold

When you buy in Dubai you are buying a specific kind of ownership. Freehold gives you the unit outright in designated zones; leasehold gives you a long lease that eventually reverts. Here's what each one actually means, where it applies, and what to verify on the title deed before you sign.

The ownership types

Freehold

Full, perpetual ownership of the unit and a share of the land, registered in your name on a DLD title deed. Available to all nationalities, but only inside designated freehold zones (e.g. Dubai Marina, Downtown, Palm Jumeirah, Business Bay, JVC, Dubai Hills). This is what most foreign investors are buying.

Leasehold

A long-term lease — usually up to 99 years — granting use of the property while the freeholder retains the underlying land. Common in some older or master-developer areas. At expiry the property reverts to the freeholder unless renewed; the remaining lease term materially affects value and mortgageability.

Commonhold

The structure that sits under most apartment buildings: you freehold-own your individual unit and jointly own the common areas through an owners' association, which levies the service charge. Your title is freehold; the building is governed collectively.

Usufruct / Musataha

Registered long-term rights (usufruct = right to use, up to 99 years; musataha = right to build/develop, up to 50 years, renewable). You see these on some commercial and master-planned plots rather than typical residential resale.

Four realities to plan around

Read the title deed, not the brochure

The DLD title deed states the tenure. Confirm it says freehold (or read the lease term if leasehold) before you commit — marketing language is not the legal record.

Freehold zones are geographic

Foreign freehold ownership is allowed only in designated areas. A unit outside those zones may be leasehold or restricted regardless of how it's advertised. Verify the area's status.

A short remaining lease is a discount and a financing risk

Leasehold value decays as the term shortens, and lenders shy away from short leases. Always check years remaining — not just the original 99.

Apartments are freehold + an association

Owning a freehold apartment still means joining the owners' association and paying service charges for the shared structure. Budget that as part of total cost of ownership.
